Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyEvidencePackage, operated by Compass AI, Inc.("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service is intended exclusively for licensed attorneys, paralegals, and authorized law firm staff ("Attorneys"). By registering, you represent that you are authorized to practice law or work under the supervision of a licensed attorney in your jurisdiction, and that your use complies with all applicable professional conduct rules, including your jurisdiction's rules regarding client confidentiality and electronic communications.

You may not use the Service for any unlawful purpose, to collect evidence for use against the individuals submitting it without proper legal authority, or in any manner that violates applicable professional conduct rules.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. One firm account is permitted per professional email domain. You agree to notify us immediately of any unauthorized use.

We reserve the right to refuse registration or terminate accounts that we determine, in our sole discretion, violate these Terms or applicable law.

MyEvidencePackage provides a platform for law firms to: (a) generate secure, time-limited client submission links; (b) collect client-submitted evidence including text descriptions, photographs, documents, and videos; (c) generate AI-assisted evidence summaries and reports; and (d) export attorney-ready PDF evidence packages.

Reports, summaries, and analysis generated by the Service are produced using large language model AI technology and are provided as tools to assist attorneys — they do not constitute legal advice and may contain errors, omissions, or inaccuracies.

You are solely responsible for reviewing, verifying, and exercising independent professional judgment about all AI-generated content before relying on it in any legal proceeding or providing it to clients. We make no representations about the legal sufficiency, accuracy, or completeness of AI-generated reports.

As an Attorney using the Service, you are solely responsible for:

• Ensuring your use complies with all applicable rules of professional conduct, including confidentiality obligations under your jurisdiction's version of ABA Model Rule 1.6;
• Obtaining any necessary client consents for electronic evidence collection and AI processing;
• Verifying the identity and authorization of clients submitting evidence through your portal links;
• Reviewing all AI-generated content for accuracy before relying on it professionally;
• Maintaining appropriate supervision over the Service's use within your firm;
• Ensuring that submission links are shared only with authorized individuals.

We are a technology provider, not a law firm, and do not provide legal advice or legal services.

You retain ownership of all case data, client submissions, and reports generated through your account ("Client Data"). By using the Service, you grant us a limited license to store, process, and transmit Client Data solely to provide the Service.

We do not use Client Data to train AI models. We process evidence submissions using third-party AI infrastructure (Anthropic) for report generation. Submissions are processed under data processing agreements that include confidentiality obligations. See our Privacy Policy for full details.

You are responsible for asserting and maintaining any applicable attorney-client privilege or work product protection over Client Data. The Service is designed to support but cannot guarantee the preservation of privilege.

Paid plans are billed monthly. Your subscription renews automatically at the end of each billing period unless canceled. Package counts reset at the start of each billing cycle. Trial plans provide full access for 14 days; no credit card is required to start a trial.

All payments are processed through Stripe. We do not store payment card information. Fees are non-refundable except as required by applicable law or as expressly stated in our refund policy. We reserve the right to change pricing with 30 days' notice.

You agree not to:

• Use the Service to collect evidence in violation of applicable law or court orders;
• Attempt to circumvent plan limits, trial periods, or access controls;
• Reverse engineer, decompile, or create derivative works from any part of the Service;
• Use the Service to process sensitive categories of personal data (e.g., protected health information) without appropriate safeguards;
• Resell or sublicense access to the Service without our written consent;
• Transmit malware, spam, or otherwise interfere with the Service.

The Service, including its design, software, trademarks, and underlying technology, is owned by or licensed to Compass AI, Inc.. Nothing in these Terms transfers any intellectual property rights to you except the limited license to use the Service as described herein.

You retain all intellectual property rights in Client Data and any content you upload. By submitting content, you grant us a limited license to process it as necessary to provide the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR LEGALLY SUFFICIENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPASS AI, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PROFESSIONAL SANCTIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Compass AI, Inc.and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any professional conduct rules, or your infringement of any third-party rights.

You may cancel your account at any time through the billing settings. We may suspend or terminate your account for material breach of these Terms, non-payment, or as required by law. Upon termination, you may request an export of your Client Data within 30 days; after that period, data may be deleted in accordance with our retention policy.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property violations. You waive any right to participate in a class action.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
